On the Golden Balls programme could a contestant sue the opponent for breach of contract?

When a contestant promises to Split and then shakes hands on it, and then goes on to Steal the money, surely the losing contestant could sue for breach of contract. After all, a verbal contract is binding and there is visual evidence to prove the agreement has been made. I hate the way it rewards people for lying and cheating.

Nobody would bother playing the game if that were so.
